1. Alpha Programme Status

Evagene is provided solely as an early-stage alpha preview for evaluation and feedback purposes. It is not a commercial product. No representation is made that Evagene is complete, reliable, stable, secure, or fit for any particular purpose. Features described on the Evagene website, in marketing materials, or in any communication are aspirational and may not yet be implemented, may be partially implemented, or may be removed at any time.

2. Not for Clinical or Diagnostic Use

Evagene must not be used to support, inform, or make clinical decisions, medical diagnoses, treatment plans, genetic counselling recommendations, or any other decision affecting patient care or health outcomes. Any risk models, scores, calculations, or analyses produced by Evagene are provided for demonstration and evaluation purposes only and must not be relied upon. Users are solely responsible for any decisions they make. Evagene expressly disclaims any liability arising from reliance on its outputs.

3. No Warranty

Evagene is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. This includes, without limitation, any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, completeness, or security. Evagene does not warrant that the service will be uninterrupted, error-free, or free of harmful components.

4. Data Loss and Service Interruption

You should expect frequent, unannounced changes to Evagene's functionality, including but not limited to: feature additions, modifications, and removals; changes to data formats and storage; complete resets of all user data; and extended periods of unavailability. You should assume that any data you enter into Evagene may be lost at any time without notice and without the ability to recover it. Evagene accepts no responsibility for any loss of data, howsoever caused. You are solely responsible for maintaining independent backups of any data you enter.

5. Limitation of Liability

To the maximum extent permitted by applicable law, Evagene and its owners, directors, employees, agents, contractors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to: loss of data, loss of profits, loss of revenue, loss of goodwill, business interruption, personal injury, emotional distress, or any other damages or losses arising out of or in connection with your use of, inability to use, or reliance upon Evagene, even if Evagene has been advised of the possibility of such damages. This limitation applies regardless of the theory of liability, whether in contract, tort (including negligence), strict liability, or otherwise.

6. Privacy and Data Protection

Evagene is in an early stage of development and does not yet have formal privacy or data protection policies, certifications, or compliance measures in place. By using Evagene, you acknowledge and accept that:

• Your data may not be encrypted at rest or in transit.
• Your data may be stored in jurisdictions that do not provide the same level of data protection as your home jurisdiction.
• Your data may be accessed by Evagene's development team for debugging, testing, and improvement purposes.
• Evagene may not yet comply with GDPR, HIPAA, or any other data protection regulation.
• You must not enter real patient data, personally identifiable health information, or any data subject to regulatory requirements into Evagene.

7. Marketing Communications

By joining the Evagene alpha programme, you consent to receiving marketing communications from Evagene, including but not limited to: product updates, feature announcements, newsletters, surveys, and promotional materials. This consent is a condition of participation in the alpha programme. If you wish to withdraw your consent to marketing communications, you may do so at any time; however, withdrawal of marketing consent will result in removal from the alpha programme and revocation of access to Evagene. To withdraw consent, contact Evagene or use the unsubscribe mechanism provided in any marketing email.

8. Intellectual Property

All intellectual property rights in Evagene, including but not limited to software, design, text, graphics, logos, and trademarks, are owned by Evagene or its licensors. Your participation in the alpha programme does not grant you any rights, title, or interest in Evagene's intellectual property. Any feedback, suggestions, ideas, or improvements you provide may be used by Evagene without restriction, attribution, or compensation.

9. User Conduct

You agree not to: reverse-engineer, decompile, or disassemble Evagene; attempt to gain unauthorised access to any systems or data; use Evagene for any unlawful purpose; share your alpha access credentials with third parties; or publicly benchmark, review, or disclose performance characteristics of Evagene without prior written consent.

10. Termination

Evagene may terminate your access to the alpha programme at any time, for any reason or no reason, without notice. Upon termination, your right to use Evagene ceases immediately. Evagene is under no obligation to retain, return, or migrate any of your data following termination.

11. Indemnification

You agree to indemnify, defend, and hold harmless Evagene and its owners, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of Evagene, your violation of these terms, or your violation of any rights of a third party.

12. Changes to These Terms

Evagene reserves the right to modify these terms at any time without prior notice. Changes take effect immediately upon publication on this page. Your continued use of Evagene following any changes constitutes acceptance of the revised terms. It is your responsibility to review these terms periodically.

13. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These terms constitute the entire agreement between you and Evagene regarding your participation in the alpha programme and supersede all prior agreements, understandings, and communications, whether written or oral.
